You “The Client” agrees to pay in full before any services are started. Once your payment is made you are agreeing to all of the terms and conditions listed here & the Terms Of Service serve as your contract. 

 

You will also receive a copy of the “Terms & Conditions” via email for your reference. 

 

If a project is canceled by “The Client”, for any reason, AFTER the project has been started your payment is/will be forfeited. Under no circumstance will refunds or credits be issued after labor has been placed into the project.

 

If the project was already started before being canceled the draft files remain the property of The Fox Formula.

If a project is canceled by “The Client”, for any reason, BEFORE the project has been started your payment will then act as a credit, which can be used for any services. All credits are to expire after 30 days.
 

Please note we have the right to decline any project at any moment for any reason even after the project has been started.

If the client insists on being difficult, combative, or disrespectful services can and will be declined and projects can and will be terminated.

If the client is continuously indecisive, and picky, or if we can’t come to an agreement your project will be deemed “un-accomplishable” and we will have to terminate the project.

If any of the above situations occur you may risk losing your payment and in such situations, refunds and or credits are determined on a case by case basis. 
 

It is imperative to have some sort of vision in mind for your project. Having even the smallest vision such as a color scheme, font choice, or pictures for inspiration makes a difference. Please keep in mind that when you request a freestyle, our creative visions/styles may not match or align. This may lead to multiple revisions, and sometimes disagreements between the customer and I. The goal is to satisfy the client and provide you with a design you love therefore it is best to have a least a small concept so that the “The Fox Formula” has something to work with.

• Please read the description to assure that this is the right investment for you. 

• Add your desired service to your cart. 

• Proceed to checkout. 

• After confirmation is received please fill out the necessary form

• Failure to complete this action will result in project cancellation.

• You will be notified that your design process is about to begin.

Your response time heavily impacts the flow of any project. There is a heavy commitment to project deadlines so it is important to respond to all emails and provide all information requested for the project promptly. 

 

If there is a delay on your behalf, the completion time of your project then changes.

 

It is important that you “The Client” fill out the questionnaire within a week of submitting your purchase.

 

I encourage all clients to read the website checklist before submitting an order for a website. 

You should be prepared and gather all the necessary materials beforehand but if for any reason you do not gather your materials before purchasing I ask that you submit them within 1-2 weeks. 

 

In the event, you need more than 2 weeks to acquire all of the necessary information after your order has been submitted please reach out via email. I do understand that certain 

information may take time for you to acquire and send off, I also understand emergencies may arise, and life happens, if this is the case please communicate so we can plan accordingly. 

 

In the event, you need more than two weeks your project might be moved to start later rather than scheduled now. 

 

In good effort, I will send ONE courtesy “check-in” email if we have not heard from you within 2 weeks of the initial invoice.

 

If you are missing something from the checklist that may delay the completion time an email will be sent notifying you of such. 

 

For ALL Projects, all materials, products, and other information that was requested must be submitted before the project is started. If the requested information is not submitted once completed, You, “The Client” is responsible for uploading any remaining information and/or products.

 

Failing to respond in the middle of any project can result in a restart fee or project cancellation with no refund depending on the time frame. 

 

Once your website is live from production, or final files are sent, that concludes our production for the hired project, but not our business relationship!

I cannot stress the importance of providing as much information as possible before your project is started. It is imperative to be as detailed and accurate as possible when filling out the design form so there can be little to no revisions.

 

You are allowed up to 3 revisions for any project. 

 

All revisions must be submitted within the first week of your design being sent back to you. For example, if the initial design is sent back to you on 7/7/22 you must request changes no later than 7/14/22, If I revise the project as soon as 7/15 you then have until 7/22nd to request any additional changes. 

 

If you do not request changes within the first week of your design is completed, you will have to pay for an entirely new design. 

 

If after all 3 revisions are exhausted and you are still unsatisfied, there will be a fee for a completely new design.

 

Please be as specific as possible when requesting revisions, for example: “ I would like the font to be bolder, larger, and changed to a magenta color”

 

In some cases, you are presented with 2-3 design concepts. You can only request revisions to be made to one chosen concept. If you would like revisions to be made to more than one concept there would be an additional fee for this.

 

Once you have agreed upon a final design and your project files are emailed, made live, or the files are used by the client in any way the remaining revisions in which you did not use EXPIRE immediately.

 

If a project has to be redesigned due to a lack of prior information or wrong information given it will result in an additional fee. Examples of such projects include; invitations, flyers, business cards, etc that require pertinent information such as addresses, phone numbers, etc.

The time frame for the completion of your project is based on the type of job and the order in which it was received. 

 

Typically smaller jobs such as basic logos have the expected time frame of 1-2 weeks and larger jobs such as branding packages and websites may take 2-3 weeks. This does not include the revision stages.

 

All projects are calculated by 7 working business days, except holidays and weekends. SATURDAYS, SUNDAYS, AND HOLIDAYS ARE NOT BUSINESS DAYS.

 

Turnaround times may also be longer during peak business seasons (around major holidays) or major sales.

 

Once the order is confirmed I will let you know the timeframe for your specified order. You can reach out before purchasing to get an estimate of how long your particular order will take at that particular time. 

 

If you need something completed sooner than my standard timeframe I can expedite any job for an extra fee.

 

I do not start any jobs before intake forms are filled out AND receive all the necessary information and or photos needed to do the job. 

 

The turnaround time may be subject to change due to incorrect information being sent, late replies to emails, and other factors 

 

If we receive your design forms, information, or images late you risk the possibility of a longer turnaround time. If our cue becomes full by the time your send in the necessary materials your project may be moved to the next round and you may be assessed late fees. To avoid any delays or fees, please ensure that you are completing the design form and sending all information within the time frame specified. (Further information about time frames and fees can be found under client response times and the delayed response policy)

 

If you add on items to your existing order your turnaround time starts from the date of the latest purchase.

All correspondence will be done via email. The email will serve as a paper trail and protect both the client and The Fox Formula from “here-say” and possible miscommunication and confusion. 

 

I currently do NOT accept phone calls/video calls unless it is scheduled. 

 

Video conferences and phone calls may be recorded, and once done a follow-up email will be sent to the client to confirm that all meeting minutes recorded during the meeting are an accurate record of everything discussed during the meeting. Only once confirmation is received from the client may we proceed with any projects. 

 

Please be advised there will be no constant contact during the design process, this does NOT mean your order is not being worked on or has been overlooked. Updates On services will be provided as they’re available. Please do not try to rush the design process.

 

Please feel free to contact me if you have IMPORTANT questions I will be happy to respond, however, please do not constantly interrupt the process.  
 

Once a project has been finalized and the files have been delivered to the client, (except for Source files) you own the rights to what you have purchased.

 

Once a project is completed and all files have been sent to the client, the client can do as they please with said files.

 

The production of any original design project automatically deems The Fox Formula author and therefore the owner of such work.

 

The Fox Formula has the right to use any projects as marketing materials/advertisements. 

 

Drafts of ANY kind are used for approval purposes only. They are not to be used, edited, manipulated, copied, distributed, or taken for personal use. ALL drafts are property of ‘The Fox Formula.

 

All projects are NOT to be advertised via any social media sites before the project is completed. That is a breach of contract and projects can be left as is as well as forfeiting your payment.

 

Draft files, revision files, unselected logo proofs, premium paid fonts, stock images, themes, etc remain the property of The Fox Formula.

 

All content included on this Site is and shall continue to be the property of Thefoxformula.com and is protected under applicable copyright and other proprietary rights. Any copying, redistribution, use, or publication by you of any such content of any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site.

While offering you top customer service, we ensure you that all information received is covered and protected by our privacy policy. Your privacy is extremely important to our company and we are here to inform you about all information collected and used throughout the process will be kept private. We appreciate your consent to retain any information requested. When the below actions are taken, you are choosing to accept and consent to the terms of this policy, and the use of personal information which you disclose.

If you wish to not consent to this privacy policy, please do not further any attempts that go against the above listed.

 

Information Collected includes but is not limited to the below. All information, verbally and non-verbally, collected is documented and stored securely.

 

• Contact Information ( Name, Business Name/Entity, Phone Number, Address, and/or Email Address)

• All information provided when using our website (Subscription Pop-Ups, Email Submission Forms, Order Forms, etc.)

• Usernames and Passwords

• Purchase History

• Reviews and Concerns

Technical support is offered for 2 weeks from the date of the web design approval and transfer. Technical support will be done via email. If you are continually having issues getting familiarized with the website we can schedule ONE free video/phone call.

 

If we are removed from your platform, your technical support is void and you must reach out to your respective platforms for assistance.

Our ability to complete a project on time depends on everyone's commitment and ability to stick to a timeline. I take project deadlines seriously and hope that our clients have the same level of commitment to their project for it to run smoothly and be successful. 

 

 After 10 business days (2 full weeks) I will do a courtesy check-in via email. You will then have 1 full week to respond. 

 

After 30 days of no communication, there will be a $30 restart fee. 

After 45 days of no communication, there will be a $45 restart fee. 

After 50 days and more, your project (deals, credits, and/or free offers) will be forfeited, and no refund shall be issued. 

 

Once forfeited your entire project is now canceled and any design that was started will not be given to the client.

Please do your best to submit high-quality images for your project. Low-quality images may not achieve the look you want, fails to complement the design, and can be a bad representation of your brand and The Fox Formula.

 

If you do not have high-quality images or any images at all, I can use stock images, however, there may be an additional fee, for me to purchase them. However, stock photos can be repetitive and commonly used.

The client will be given the right to final say on all colors, fonts, text, and images used in the final design.

 

Once the client approves one of the proposed designs and receives the final files they are FINAL. There will be NO additional revisions, even if the client did not use all 3 allotted revisions.

 

Please do not rush to a decision and only submit your final draft after careful consideration.

If you are shown 3 concepts and choose 1 concept the other two are not to be used for any reason by the client unless purchased.

This agreement specifies the Terms and Conditions for access to, use of, and purchase from Thefoxformula.com 

 

By continuing the use of our site and resources, you agree to all terms and conditions listed and acknowledged. Please review these terms and conditions carefully. If you do not agree to these terms and conditions please refrain from using our site.

 

Any person or entity who interacts with the Site through the use of crawlers, robots, browsers, data mining or extraction tools, or other functionality, whether such functionality is installed or placed by such person or entity or a third party, is considered to be using the Site. If at any time you do not accept all of these Terms & Conditions, you must immediately stop using the Site.

 

All Terms & Conditions are subject to change at any time. If our Terms & Conditions change, we will post the change on our website. Once modified and posted any changes will be effective immediately unless otherwise stated in the change.

 

The Client confirms his, or her, they/ them acceptance of the modifications or updates by continuing to use the Site. Each use by you shall constitute and be deemed your unconditional acceptance of this Agreement.
